Garys Auto - Estate September 27th
Day 2 - Online Only Bidding ending on Sunday, September 27th @ 4:00PM
1. GENERAL CONDITIONS OF SALE
1.1 As-Is Sales
All items and lots are sold in “AS IS, WHERE IS” condition. All guarantees, representations, and warranties regarding any item are solely between the Buyer and the Seller. Hoge Auctioneering LLC makes no independent warranties, express or implied, regarding any item offered for sale.
1.2 All Sales Final
All sales are final. By placing a bid, the Buyer agrees to accept the item in its present condition, in its present location, and with the description provided — whether accurate or not. No refunds, returns, or exchanges will be issued.
1.3 Item Descriptions and Accuracy
Item information is obtained from Sellers. Hoge Auctioneering LLC will represent any defects we are made aware of or notice during cataloguing; however, the Buyer hereby agrees to hold harmless Hoge Auctioneering LLC and its staff for any errors or omissions regarding items being sold. Buyers are strongly encouraged to preview items and conduct all due diligence prior to placing any bids.
1.4 Authenticity
Hoge Auctioneering LLC makes no guarantee of authenticity on any item offered for sale. If you have specific questions regarding a lot, please contact our office at least two (2) business days prior to the close of the auction at 319-435-2302.
2. BIDDING
2.1 Binding Commitment
By placing a bid, you are entering into a legally binding contract to purchase the item if your bid is the winning bid. All bids constitute a firm and irrevocable offer to purchase. Bids may not be cancelled or retracted for any reason once accepted by the system.
2.2 Buyer Responsibility
It is the sole responsibility of each Buyer to:
· Preview items prior to bidding
· Review all lot descriptions, condition reports, and photographs
· Read and fully understand all Terms and Conditions before submitting any bid
If you are unable to comply with the pickup schedule, payment deadlines, or any other requirement stated herein, please do not place bids.
2.3 Maximum (Max) Bidding Explained
When you enter a maximum bid, the current bid price does not automatically increase to your maximum. The system will only increase your bid incrementally as other bidders place competing bids, up to your stated maximum. If two (2) bidders place identical maximum bids on the same item, the first bidder to submit that maximum bid will be declared the winning bidder.
2.4 Reserve Lots
If you are the current high bidder on a reserve lot but the lot displays “Reserve Not Met,” you will not be the winning bidder when the lot closes. You may continue to place additional bids until the display reads “Reserve Has Been Met,” at which point you will be the winning bidder. This is the only circumstance in which the system will allow a bidder to raise their own bid.
On unreserved lots, you may raise your maximum bid at any time; however, a competing bid must be placed before the current bid price will increase.
2.5 Refusal of Bids
Hoge Auctioneering LLC reserves the right to accept or refuse any bid for failure to comply with these Terms and Conditions or for any other reason at its sole discretion.
3. PAYMENT
3.1 Payment Deadline
Full payment must be received by the date specified in your invoice. No items will be released until payment has been received and cleared in full. Purchase is not subject to financing.

3.3 In-Person Auctions
All purchases made at an in-person auction must be settled in full before leaving the premises.
3.4 Online Auctions

4. BUYER’S PREMIUM
A Buyer’s Premium of 10% will be added to the hammer price of all online purchases. The Buyer’s Premium is non-negotiable and forms part of the total purchase price.

5. SALES TAX
Iowa state sales tax will be applied to all qualifying purchases in accordance with applicable Iowa law. Buyers are responsible for determining and complying with all applicable tax obligations.
